By accessing or using Noxtary ("the Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to all of the terms and conditions stated herein, you are prohibited from using or accessing this platform. These terms apply to all visitors, users, and others who access or use the Platform.

Your continued use of Noxtary after any modification to these Terms constitutes your acceptance of the revised Terms.

Noxtary is a digital content platform that provides access to a curated collection of digital products, including but not limited to:

• Mobile and desktop applications (apps & mods)
• Digital books, articles, and written content
• Manga, anime, and related multimedia content
• Platform and service subscriptions
• Digital audio content (music, podcasts, sound packs)
• Various digital services

Some content is available free of charge, while other content requires payment. Pricing and availability are subject to change without prior notice.

To access certain features of the Platform, you must create an account. By creating an account, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your login credentials secure and confidential
• Be responsible for all activities that occur under your account
• Notify us immediately at [email protected] of any unauthorized access to your account

Accounts are registered via Google Sign-In through Supabase. You must be at least 13 years old to create an account. We reserve the right to terminate accounts that violate these Terms.

All content available on Noxtary, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Noxtary or its content suppliers and is protected by applicable intellectual property laws.

When you purchase or access digital content on Noxtary, you are granted a limited, non-exclusive, non-transferable license to use that content for personal, non-commercial purposes only. This license does not constitute a transfer of ownership.

• You may not copy, reproduce, or distribute purchased content without explicit written permission
• You may not use any content for commercial purposes without authorization
• You may not reverse-engineer or attempt to extract source code from any software product

You agree not to engage in any of the following prohibited activities:

• Redistribution: Re-selling, sharing, or distributing any purchased digital content to third parties without explicit written permission from Noxtary
• Piracy: Uploading, copying, or making available any content from the platform on other websites or services
• Account Sharing: Sharing your account credentials with other individuals to bypass payment requirements
• Fraudulent Activity: Using stolen payment methods, initiating fraudulent chargebacks, or engaging in any deceptive practices
• System Abuse: Attempting to hack, probe, or interfere with the platform's security, servers, or infrastructure
• Automated Access: Using bots, scrapers, or other automated tools to access or extract content from the platform
• Misrepresentation: Impersonating other users, Noxtary staff, or any other person or entity

To the fullest extent permitted by applicable law, Noxtary and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Platform
• Any conduct or content of any third party on the Platform
• Any unauthorized access, use, or alteration of your transmissions or content
• Technical failures, interruptions, or errors in the Platform

In no event shall Noxtary's total liability to you exceed the amount you paid to Noxtary in the six (6) months preceding the event giving rise to the claim.

Noxtary reserves the right to modify or replace these Terms of Service at any time at our sole discretion. We will provide notice of significant changes by:

• Updating the "Last Updated" date at the top of this page
• Sending an email notification to registered users (when applicable)
• Displaying a prominent notice on the Platform

It is your responsibility to review these Terms periodically. Continued use of the Platform after any modifications constitutes your acceptance of the new Terms.

These Terms of Service shall be governed by and construed in accordance with applicable laws. Any disputes arising out of or relating to these Terms or the Platform shall be resolved through good-faith negotiation between the parties.
